The NWFP governor Syed Iftikhar Hussain Shah without legal authority has given the trust property of Islamia College Peshawar (ICP) to the Khyber College of Dentistry (KCD), sources told Daily Times on Sunday.The sources revealed that the campus police station building constructed on Islamia College land developed cracks. The KCD principal requested the government to demolish and transfer its possession to the Khyber College of Dentistry for its extension.“The governor held a meeting with the University of Peshawar vice chancellor and registrar on June 25,2002 in which he decided to hand over the land vacated after demolishing the police station’s building to the KCD,” sources disclosed.He said no invitation to the meeting was given to the administration of the Islamia College Peshawar whose property was the main item on the agenda. However, neither the governor nor anyone else had the legal authority to transfer or sell a trust property to any individual or an institution, he said. The 1937 gazetteer of Peshawar district reads; “ His Excellency the Governor is the patron of the college. All the moveable and immovable property of the Dar-ul-Ulum (College) stands in the name of the trustees, who are a registered body.” According to this the governor is the patron not the owner or competent authority to transfer or sell its property.Similarly section 3(1) of the ‘North West Frontier Province Darul-ulum-i-Islamia-i-Sarhad Act, 1949’ reads; “The provincial government shall immediately assume the administration, management and control of the Darul-ulum-i-Islamia-i-Sarhad, Peshawar, together with all the property which belongs to it or stands in its name.” This section clearly determines the government position regarding status of the ICP’s trust property. It can only administer, manage and control its property and not to transfer or sell.Section-7 of the same Act further clarifies all this as it reads “the provincial government may from time to time frame rules for the efficient administration and management of the Darul-ulum-i-Islamia-Sarhad, Peshawar, and its property.”On April 1, 1954 the ICP was entrusted to the University of Peshawar for administration, management and control but the university itself on various occasion illegally encroached upon its property in clear deviation from the rules and regulations.Ajmal Khan, the then registrar of the University of Peshawar and the incumbent principal of the ICP when contacted told Daily Times, he had attended the June 25 meeting but only demolishing of the police station building was discussed and the transfer of the land was not on the agenda. “When the minutes of the meeting were released it contained the transfer of the Islamia College Peshawar land to the KCD which was in fact not discussed in the meeting. He said the university had made a representation to the governor and they were waiting for his (governor) response.Javid Khan, registrar of the Peshawar University told Daily Times the university had issued 15-day notice to the principal of KCD to vacate the land or face legal action. “Only the syndicate is authorized to make decisions about the transfer of property,” he said. Mr Khan said the university had sold a piece of land to the KCD for Rs 8 million for the construction of a girls hostel. This land is also the property of the ICP trust. However, a legal expert observed the ICP land was not the ownership of the university and even its executive body, the syndicate, could not transfer or sell it. When the principal Khyber College of Dentistry (KCD) was contacted for comments he was not available.

Entry test for NWFP Engineering and Medical colleges
The entry test for admission to engineering and medical colleges of NWFP will be held in Peshawar and Abbottabad on August 9 and 16, respectively.
The decision was taken at the 19th meeting of Board of Governors of Educational Testing and Evaluation Agency (ETEA) held here on Tuesday. Presided over by Chief Minister Ameer Haidar Hoti, the meeting was attended by NWFP Minister for Higher Education Qazi Mohammad Asad, secretary for higher education, vice-chancellor, Engineering University Peshawar, chairman, Higher Education Regulatory Authority, principal, Gomal University, chairman, Board of Intermediate and Secondary Education, Malakand and officials of the health department.
Revised budget of ETEA for the year 2008-09 and budget estimates for the year 2009-10 were also approved during the meeting. It was decided that the Bannu Examination Centre would be cancelled and its candidates be allowed to appear for the test at the Peshawar centre. The entry test at Peshawar would be held at Karnel Sher Khan Shaheed Stadium and at Ayub Medical College in Abbottabad. Administrative Committees were also approved for Peshawar and Abbotabad centres, which would look after the matters related to the test.

Girls outshine boys in BISE Peshawar HSSC examinationPeshawar, July 22: The girl's students of Jinnah College, Peshawar have outclassed boys by grabbing all the three top positions in the Higher Secondary School Certificate's annual examination of Board of Intermediate and Secondary Education Peshawar 2009. According to results, Bushara Khalid, Roll No. 50665, has topped the overall and pre-medical group of the intermediate examination by obtaining 968 marks, Sana Pervez Roll No. 50667 with 960 marks stood second while Humeria Usman Roll No.50658 grabbed third position respectively.
The position-holders are students of Jinnah Collage Peshawar. The students of Islamia College Peshawar have clinched the first, second and third position in pre-engineering group as Faheemullah Roll No. 60734 grabbed first position with 949 marks, Bilal Khan Roll No. 60689 with 945 marks and Shah Rukh Khan Roll No. 60667 with 930 marks obtained third position respectively.
In Humanities Group, Nasir Shahzad Roll No. 76246 of Islamia College Peshawar secured Ist position, Hina Habib Roll No. 71501 of Jinnah College with 875 marks grabbed second position while the third position was shared by Neelum Ali Roll No.71508 of Jinnah College and private candidate Shakeela Naz Roll No.88226.
In Theology Group, Syed Tayyib Shah of Islamia College Peshawar clinched first position with 893 marks. Overall 34557 candidates were appeared in Part-1 out of whom 22524 were declared successful with passing percentage of 65.18. In Part-I Pre-Medical Group, total 6839 regular candidates were appeared out of whom 5534 were declared successful with 80.90 percent success ratio.
In Part-1 Pre-Engineering group, a total 5610 regular candidates tried their luck out of whom 4639 were declared successful with 82.89 percent success ratio. In General Science Group, a total of 2722 regular candidates appeared out of whom 1772 have passed it with passing percentage of 65.09.
In Part-II Pre-Medical Group, 5025 candidates were declared successful out of 5813 regular candidates with 86.44 percent success ratio. Likewise, in Pre-Engineering Group, a total of 3987 passed the annual examination out of 4405 regular candidates with success ratio of 90.51 percent.
In General Science Group of Part-II, as many as 1916 regular candidates were appeared out of whom 1428 were declared successful with 74.53 percent success ratio. Medical was topped by Miss Bushra Khalid Roll No 50665 getting 968 out of 1100. She has been the student of the reknowned Institution, Jinnah College for Women, Peshawar.
